1. SCOPE OF APPLICATION
1.1. This policy applies to distance contracts concluded through the online store www.safetyone.ro between SAFETY ONE PRO SRL (hereinafter referred to as “SafetyOne”) and consumers — natural persons acting for purposes outside their trade, business, production, craft or professional activity, within the meaning of Government Emergency Ordinance No. 34/2014.
1.2. For customers who are legal entities, the statutory right of withdrawal described in this policy does not apply; the return conditions shall be those agreed contractually.
2. RIGHT OF WITHDRAWAL. TIME LIMITS
2.1. You have the right to withdraw from the contract within 14 calendar days, without having to provide any reason for your decision to withdraw and without incurring any costs other than those provided for in Sections 4 and 5 below.
2.2. The 14-day period shall run from the day on which you, or a third party indicated by you, other than the carrier, acquire physical possession of the products. Where the products included in a single order are delivered separately, the period shall run from the receipt of the last product.
2.3. SafetyOne Benefit: We voluntarily extend this period to 30 calendar days from the date of receipt of the products. All conditions set out in this policy shall apply identically throughout the entire 30-day period.
3. METHODS OF WITHDRAWAL
You may choose any of the following methods:
a) Online withdrawal function (recommended): access the Withdraw from the contract here button, permanently available in the footer of the website and in your customer account, under the “My Orders” section. The function is also available for orders placed without an account. Complete the online withdrawal declaration by providing your name, order number, email address and the products concerned, check the displayed information and click “Confirm withdrawal”. You will immediately receive, by email, an acknowledgement of receipt of the withdrawal, including the content of your declaration, as well as the date and time when it was submitted.
b) Withdrawal form (open): completed and sent by email to comenzi@safetyone.ro or by courier to the address indicated in the header of this policy.
c) Any other unequivocal statement expressing your decision to withdraw, sent by email or by courier.
3.1. The withdrawal deadline shall be deemed to have been met if you send the withdrawal declaration before the expiry of the period provided for in Section 2. The burden of proof regarding the exercise of the right of withdrawal rests with you; we recommend that you retain proof of submission. The acknowledgement of receipt sent by email certifies the date and time of submission.
4. RETURN OF PRODUCTS
4.1. You must return the products without undue delay and no later than 14 calendar days from the date on which you informed us of your withdrawal. The deadline shall be deemed to have been met if you dispatch the products before the expiry of the 14-day period.
4.2. For your convenience, we provide the following return options:
a) via GLS courier (the parcel will be collected from your address) — cost: RON 33.50, VAT included;
b) via Sameday Easybox (you must deposit the parcel in the Easybox locker of your choice; after confirmation of the withdrawal, you will receive a link for generating the code required to deposit the return parcel in the Easybox locker) — cost: RON 17, VAT included.
4.3. Alternatively, you may return the products by any other method of your choice, at your own expense, to the following address: SAFETY ONE PRO SRL, Str. Drum Incintă, Lot 33 (C36), Mihail Kogălniceanu village, Mihail Kogălniceanu commune, Constanța County, Romania. We recommend using a tracked delivery service and retaining proof of dispatch.
4.4. Parcels sent with the shipping costs payable by the recipient upon delivery cannot be accepted.
5. REFUND OF AMOUNTS PAID
5.1. We will refund all amounts received from you as payment, including, where applicable, the cost of the initial delivery, without undue delay and, in any event, no later than 14 days from the date on which we are informed of your decision to withdraw.
5.2. Exception: if you expressly selected a delivery method that was more expensive than the standard delivery method offered by us, the additional costs, namely the difference compared with the standard delivery cost, will not be refunded.
5.3. We may withhold the refund until the date on which we receive the products back or until you provide us with proof that you have dispatched them, whichever occurs first.
5.4. The refund will be made using the same payment method as that used for the initial transaction, without any fees being charged to you. A different method, for example a bank transfer for orders paid for by cash on delivery, will be used only with your consent, based on the bank account indicated in the withdrawal declaration.
5.5. If you have chosen the return option via GLS or Easybox provided by SafetyOne under Section 4.2, the corresponding cost will be deducted from the amount refunded.
6. CONDITION OF THE PRODUCTS. DIMINUTION IN VALUE
6.1. You may open the packaging and inspect the products in order to establish their nature, characteristics and functioning, in the same way as you would in a physical store — including trying on items of clothing and footwear.
6.2. You are liable only for any diminution in the value of the products resulting from handling beyond what is necessary to establish their nature, characteristics and functioning, for example: actual wearing or use, washing, damage, stains, removal of labels through use, or missing accessories.
6.3. Any diminution in value will be assessed upon receipt of the products, communicated to you and deducted from the amount to be refunded. A diminution in value does not constitute grounds for refusing the withdrawal.
6.4. Please return the products in packaging suitable for transport, together with the relevant accessories and labels.
7. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
Pursuant to Article 16 of Government Emergency Ordinance No. 34/2014, the right of withdrawal shall not apply, in particular, to:
a) products made or personalised according to your specifications, including embroidery, screen printing, heat transfer and customised printing;
b) sealed products which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery;
c) other situations expressly provided for under Article 16 of Government Emergency Ordinance No. 34/2014.
8. PRODUCT EXCHANGE (COMMERCIAL SERVICE)
8.1. Separately from the statutory right of withdrawal, SafetyOne offers you the option to exchange a product for another product, such as a different size or model, within 30 calendar days of receipt.
8.2. Procedure: complete the exchange form; a SafetyOne representative will confirm your request within a maximum of 5 business days and will inform you of the delivery time for the replacement product, together with all relevant details. Following confirmation, we will arrange for the GLS courier to collect the parcel, or you will receive the Sameday link required to deposit it in an Easybox locker.
8.3. The transport costs, namely the return cost of RON 33.50, VAT included, via GLS, or RON 17, VAT included, via Easybox, together with the delivery cost of the replacement product, shall be borne by you and shall be paid upon delivery of the replacement product.
8.4. The exchange is subject to the availability of the replacement product and to the returned product being in an appropriate condition, namely unworn and with the labels attached. Personalised products cannot be exchanged.
8.5. The exchange is a commercial facility offered voluntarily by SafetyOne; it does not limit or make conditional in any way the statutory right of withdrawal described in Sections 2–6.
9. PROTECTION OF PERSONAL DATA
9.1. The personal data provided through the withdrawal declaration or the product exchange form, including your name, contact details, order number, the products concerned and, where applicable, your bank account details, are processed by SAFETY ONE PRO SRL, acting as data controller, for the purpose of managing the withdrawal or exchange and complying with the related legal obligations.
9.2. Legal basis for processing: Article 6(1)(c) of Regulation (EU) 2016/679, namely compliance with a legal obligation under Government Emergency Ordinance No. 34/2014, and Article 6(1)(b), namely performance of the contract, in relation to the product exchange service.
9.3. Withdrawal declarations and acknowledgements of receipt shall be retained for 3 years from the date on which the matter is resolved, for the purpose of demonstrating compliance.
